Terms of Service

By booking a photography session with Vision Skyworks, LLC, you (“Client”) agree to the following terms and conditions:

1. Services

Vision Skyworks, LLC will provide photography services as specified in your booking confirmation. Services may include interior photography, exterior photography, aerial drone photography, twilight photography, and virtual tours / 360° photography.

2. Booking and Payment

All sessions must be scheduled in advance. A booking confirmation will be sent to you upon scheduling.
Full payment is required upon delivery of the final images unless otherwise agreed in writing.

3. Cancellation and Rescheduling

You may reschedule your session at least 24 hours in advance without penalty. Rescheduling requests made less than 24 hours in advance may be subject to a rescheduling fee of $25.

4. Weather Policy

For outdoor or aerial sessions, the Photographer reserves the right to reschedule the session due to inclement weather conditions that may impact image quality or safety. You will be notified as soon as possible to arrange a new date.

5. Property Preparation

You are responsible for ensuring the property is clean, tidy, and ready for photography. The Photographer is not responsible for moving objects, cleaning, or staging the property.

6. Image Delivery

Edited images will be delivered within two business days of the session date.
Images will be delivered electronically via a secure online gallery or file transfer service. You will receive a link to download the images.

7. Usage Rights and Licensing

The Photographer retains all copyrights to the images and may use them for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
You are granted a non-exclusive, non-transferable license to use the images for marketing and advertising purposes related to the sale or rental of the property. You may not sell, transfer, or sublicense the images to any third party without the Photographer’s prior written consent.

8. Liability

The Photographer is not liable for any damage to the property or any injury that occurs during the photography session. You agree to indemnify and hold harmless the Photographer from any claims arising from the photography session.

9. Confidentiality

The Photographer agrees to keep any information regarding the property and you confidential and will not disclose such information to any third party without your prior written consent.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Indiana. Any disputes arising from this Agreement shall be resolved in the courts of Indiana.

11. Amendments

Any amendments or modifications to this Agreement must be made in writing and signed by both the Photographer and you.

12. Entire Agreement

This Agreement constitutes the entire agreement between the Photographer and you and supersedes all prior agreements, understandings, and representations, whether written or oral, regarding the subject matter hereof.
